Background
Following the political changes in Bangladesh caused by the mass uprising in July 2024, the interim government has taken the initiative to replace the widely debated Cybersecurity Act of 2023 (Law No. 39 of 2023) with a new ordinance. We first congratulate everyone involved in this process. It would not be an exaggeration to say that one of the key factors behind the July movement was the extensive and sufficient misuse of the provisions of the Cybersecurity Act 2023 by the previous government. By restricting the freedom of expression of the public and introducing an unlimited surveillance culture within the country with the help of state structures, the law, along with its predecessor, the Digital Security Act 2018, played a role in creating a stifling atmosphere of fear. Therefore, when the interim government decided to cancel the 2023 law and draft a new ordinance, it naturally became a subject of great public interest.
The cyber world or cyberspace is a vast and expansive concept. In today's world, it is almost impossible, though very difficult, to find anyone whose interests are not related to some aspect of this domain. Additionally, with the rapid development of various digital technologies, it is only a matter of time before everyone's interests will necessarily be linked to this space. Considering all matters related to cyberspace and the general practices of various countries in the civilized world, it is evident that it is not possible to ensure the protection of all interests through a single law alone.
